Use of Service
SwimmingOS is provided as a swim club management platform. You may use the service only in accordance with these terms, applicable law, and any documentation or policies we make available. You are responsible for the way your organisation and its users use the service, and for ensuring that use complies with data protection and other relevant laws.
Subscription Model
Access to SwimmingOS is offered on a subscription basis. Fees, billing cycles and any limits (such as included swimmers) are set out in your agreement or order form. Subscriptions renew in accordance with your chosen plan unless cancelled in line with our cancellation policy. We may change pricing or terms on notice where permitted by your agreement.
Responsibility
You are responsible for the accuracy of data you enter, for maintaining secure access credentials, and for the conduct of users you authorise. You must not use the service for any illegal purpose or in a way that infringes the rights of others. We reserve the right to suspend or terminate access where we reasonably believe there is a breach of these terms or a risk to the service or others.
Data Usage
We process data as described in our privacy policy and in our data processing agreement where one applies. You retain ownership of your data. We use it only to provide, support and improve SwimmingOS, and as required by law. You grant us the limited rights necessary to operate the service and to use anonymised or aggregated insights where we describe in our policies.
Limitation of Liability
To the fullest extent permitted by law, SwimmingOS is provided “as is”. We do not guarantee uninterrupted or error-free operation. Our total liability to you in connection with the service is limited to the amount you paid us in the twelve months before the claim, except where law does not allow such limitation. We are not liable for indirect, consequential or special damages, or for loss of data, revenue or profit, except where such exclusion is not permitted by law.
